Copyright Act 1957

“Copyright” law is an act by which the original works of a person are legally protected so that the rights of the original works of the person can be protected. The Copyright Act, 1957  became a law in India in the year 1957. The subject of copyright law in India is governed by the Copyright Act 1957. This act is called number 14 of 1957. Under this act, special rights are given to a person for his original work. Copyright Act 1957 Many types of works have been included in the Copyright Act, which we will discuss further. The Copyright Act, 1957 has 15 chapters and 79 sections.


Which works are covered by copyright

  • Literary works: Literary work comes first, in which all the work related to writing is included, for example writing a book, writing a story and poem, writing an article comes under this.
  • Musical works: Under this, a musical composition or song composed by a musician has been included.
  • Dramatic works: It includes plays or drama, any script, screenplay etc.
  • Artistic work: It includes those works which show the artistic skill of a person such as painting, drawing and sculpture etc.
  • Cinematography film: This includes visual recording ie any act of visual recording such as video films, movies or any work related to cinematography.
  • Architecture Blueprint: Creating a blueprint for the design of a building comes under architecture.
  • Sound Recording: Any sound recording like music, podcast or other sounds come under this.
  • Computer program or software: Software or computer program made by an individual or by an IT company also comes under copyright.


Is it possible to use a work without violating copyright law?

The answer is yes, but some conditions have been prescribed for this. It's worth noting that your content may be removed in response to a copyright infringement claim, even if you can say the following


  • The copyright owner is credited.
  • Has not earned money from infringing content.
  • Fee has been paid for copying the material in question.
  • Have seen similar content elsewhere on the Internet.
  • The material has been purchased with hard or digital copy.
  • The content itself is recorded from the TV, movie theater or radio.
  • Copied the material itself from a book, movie poster or photograph.
  • It is stated that "no copyright infringement is intended".

What is Copyright Infringement?

Whenever a person uses any copyrighted material without the permission of  owner of that material, it is called copyright infringement. Let us tell you that under the Copyright Act, 1957, an original owner gets exclusive legal rights over his work, which provides him with various types of benefits. According to the Copyright Act, 1957, it is an offense to infringe the rights enjoyed by the copyright owner.

Process of copyright registration

First of all, you have to go to the official website http://copyright.gov.in.

You will get the option to fill the application online.
Form 904 will be filled for copyright registration.
To fill the copyright registration form, you have to mention your personal details like- name, address, nationality.

  • The work to be copyrighted has to be told.
  • Trend of work - In this, you have to fill a short description of the work on which you want to copyright.
  • If a website or blog or youtube is to be copyrighted, then its URL has to be given.
  • Publication Details- In this you have to give publication of work, date of start or publisher or research related work.

What is the punishment under the Copyright Act?

If found guilty of violating the Copyright Act, there is a provision of monetary fine with imprisonment of up to 1 year. Damage claim can also be made for copyright infringement.
